Referral Program Terms

Acceptance of Qovex Referral Program Terms

By accessing and participating in the Qovex Referral Program (“Referral Program”) you agree to accept and comply with the terms and conditions of this Referral Program (“Referral Program Terms”) and any other applicable conditions communicated to you when entering the Referral Program. You should read the entire Referral Program Terms carefully before accessing and participating in the Referral Program.

As used in these Referral Program Terms, “Qovex” may refer to each of the following entities, its owners, directors, investors, employees:

  • Qovex USA, Inc., registered with the Registrar of Companies in the state of Delaware with registration number 5481543 and with registered office at 27 Union Square West, New York, NY 10003, United States of America,

  • Qovex Europe S.A., a payment institution authorised and regulated by the Luxembourg financial regulator, the Commission de Surveillance du Secteur Financier, registered with the Luxembourg Trade and Companies Register under the number B0196856, VAT number LU 27823117, with its registered address at 40, avenue Monterey, L-2163 Luxembourg, Grand Duchy of Luxembourg,

  • Qovex Ltd, registered with Companies House in with registration number 08157033 and with registered office at 1300 E 9TH ST STE 1205 CLEVELAND OH 44114, , .

  • Qovex Global Ltd, registered with the Registrar of Corporate Affairs in the British Virgin Islands with the registration number 2086429 and with registered office at Floor 4, Banco Popular Building, Road Town, Tortola VG1110, British Virgin Islands.

“Qovex” in each case refers to the entity which you are the customer of. Depending upon the context, “Qovex” may also refer to the services, products, website, content, or other materials (collectively “Qovex Services”) provided by each respective entity listed above to you as its customer.

Qovex reserves the right to change, add or remove parts of these Referral Program Terms at any time and at its sole discretion. You will be notified of any changes in advance through your Account. Upon such notification, it is your responsibility to review the amended Referral Program Terms. Your continued participation in the Referral Program following the posting of a notice of changes to the Referral Program Terms signifies that you accept and agree to the changes, and that all subsequent actions by you will be subject to the amended Referral Program Terms.

Eligibility

In order to access and participate in the Referral Program and be eligible to refer potential new users to Qovex (act as a “Referrer”), you must meet all of the following conditions:

  • be a user of the Qovex exchange platform,

  • your country of nationality being eligible to participate in this Referral Program (please see the list of eligible countries here),

  • maintain an active and verified account, opened at least 30 days prior to entering the Referral Program,

  • maintain your account in good order and in accordance with provisions of applicable Terms of Use,

  • perform at least one trade on the Qovex exchange platform.

In order to access and participate in the Referral Program and be eligible to be provided a referral by a Referrer (be a “Referee”), you must meet the following conditions:

  • not be a user of Qovex exchange platform or hold an account on the Qovex exchange platform,

  • your country of nationality being eligible to participate in this Referral Program (please see the list of eligible countries here),

  • use a valid referral link or referral code (“Referral Link”) provided by a Referrer, and

  • perform at least one trade on the Qovex exchange platform.

Referral Program Description

When you access and participate in the Referral Program, Qovex will provide you, acting as a Referrer, with a Referral Link, or any other similar way of inviting potential new users to become users of Qovex exchange platform.

The Referral Program is intended to let Referrer or Referee or both Referrer and Referee earn a certain reward when a Referee registers its account and completes a trade (“Referral Reward”).

Restrictions

As a Referrer, you are eligible to invite others to become new users by sharing your Referral Link directly with them in order to open an account with Qovex. Referee may use the Referral Link only once. There is no possibility to combine multiple Referral Links.

Referral Link should be used as a personal invite and for non-commercial purposes only. Corporate users of Qovex exchange platform and potential new corporate users are not eligible to participate in the Referral Program.

When using the Referral Link as a personal invite, you are prohibited from the following actions:

  • spamming, mass emailing, or performing any similar mass messaging,

  • using automated systems, bots, or scripts,

  • misleading or attempting to mislead anyone in connection with the Referral Program, in connection with your relationship with Qovex, in connection with functionalities of Qovex exchange platform, or in connection to services provided by Qovex,

  • creating multiple or fake accounts, websites, or profiles, and

  • using the Qovex brand or the referral program in connection with any offensive, abusive, harassing content, content that violates any laws or regulations, or defamatory content related to Qovex or any third parties, as determined by Qovex in its sole discretion.

In relation to the Referral Program, Qovex reserves the right to:

  • limit the use of the Referral Link (number of shares of the link or in any other way),

  • impose additional restrictions related to eligibility,

  • deactivate your Referral Link at any time at its own discretion,

  • disqualify any actions performed by the Referrer or Referee and not award any Referral Rewards at its own discretion, and

  • accept any other appropriate measure to protect the Referral Program and Qovex interests.

Referral Rewards

In accordance with these Referral Program Terms, you are eligible to earn a Referral Reward. The Referrer and the Referee receive the Referral Reward only in cases when both are eligible to participate in the Referral Program in accordance with these Referral Program Terms or other applicable terms. In case any of the two is not eligible to participate in the Referral Program or not eligible to receive the Referral Reward, no Referral Reward will be provided.

The amount of the Referral Reward may vary based on the specific Referral Program campaign you will enter or based on other terms and conditions described here or communicated to the eligible participants before using the Referral Link or participating in the Referral Program. The amount that both Referrer and Referee may redeem will always be communicated before entering the Referral Program and being presented with the Referral Link.

Any received trading bonuses from the Referral Program campaign which was running until 31 January 2021 that will not be redeemed by 30 June 2021 will no longer be available after that date.

Qovex reserves the right to credit the Referral Reward to the eligible users within 15 days from meeting the conditions for receiving the reward.

In order for the Referrer and/or Referee to receive the Referral Reward, the Referee needs to initiate a buy or sell of certain cryptocurrency in the total amount communicated to both Referrer and Referee when entering the Referral Program or accepting Referral Program Terms. There is a maximum limit of $100 of the value of Referral Rewards each Referrer or Referee can receive in total in a calendar year.

Qovex reserves the right to suspend your account or to deny, cancel the distribution, deactivate Referral Links, or deduct any Referral Rewards received or yet to be received in the event that it determines or believes that the Referral Reward was received in fraudulent manner, in error, or in violation of these Referral Program Terms or any other applicable terms.

Referee must respond (create and verify a new account) before the Referral Program ends. After the registration, Referee has 30 days to place a trade and redeem the reward.

Any tax consequences that may result from receiving or using any Referral Rewards are the sole responsibility of Referrer and/or Referee.

Miscellaneous

This Referral Program is a courtesy offered by Qovex and does not create any legal obligations that may be enforced in front of court. Qovex expressly reserves the right to replace the Referral Program by any other referral and/or loyalty program and/or to cease this Referral Program in its entirety.
